In such cases, the Application will receive from the relevant provider only the information necessary to create and manage the User’s Account and to provide the Services, which may include:

Where the User registers or logs in via a third-party authentication service, the User may be requested, after initial registration, to provide additional information required for the provision or personalization of the Services, equivalent to the information requested during direct registration through the Application, except for the creation of a password.

Before proceeding, the User must confirm that they have reviewed and agreed to these Terms & Conditions and the Privacy Notice.

The User may delete their Account at any time via the profile settings on the Application. Upon deletion, all Personal Data associated with the Account will be removed in accordance with Our Privacy Notice, unless retention is required by applicable law.

Some subscriptions may include a free trial for eligible Users. Unless You cancel at least 24 hours before the free trial ends, Your subscription will automatically begin at the end of the trial period and You will be charged chosen subscription price when the trial ends. You can manage or cancel Your subscription at any time through Your Apple ID account settings. Cancellation takes effect at the end of the current billing period, and You will continue to have access to premium features until the period ends.

For avoidance of doubt, deleting the Application or closing an Account does not cancel an active subscription purchased through the Apple App Store; subscriptions must be managed through the User’s Apple ID settings in accordance with Apple’s rules.

Refunds for subscriptions and other purchases made through the Apple App Store are handled by Apple, not by Us. Refund decisions are made by Apple in accordance with Apple’s policies and procedures.

13. INDEMNIFICATION

To the maximum extent permitted by applicable law, You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, contractors, and agents from and against any third-party claims, demands, actions, and proceedings, and any related losses, damages, liabilities, and reasonable costs and expenses (including reasonable attorneys’ fees), arising out of or relating to: (a) Your breach of these Terms or any documents incorporated by reference; (b) Your unlawful use of the Application or Your violation of applicable law; (c) Your infringement or alleged infringement of the rights of any third party (including intellectual property, privacy, or other rights), including through User’s Content or data You submit to the Application (such as information relating to another individual for compatibility features).

The Company will use reasonable efforts to notify You of any claim for which indemnification is sought, and You agree to reasonably cooperate with the Company in the defense of such claim.

The Company reserves the right to assume control of the defense of any matter subject to indemnification (at the Company’s expense, unless otherwise agreed or permitted by applicable law). You agree not to settle any such matter in a way that imposes any obligation or admission of liability on the Company without the Company’s prior written consent (not to be unreasonably withheld).

Nothing in this Section limits or excludes any liability that cannot be limited or excluded under applicable law, including mandatory consumer protection rules.

If indemnification obligations are prohibited or restricted under applicable law in Your jurisdiction, this Section shall apply only to the extent permitted by such law.

14. FORCE MAJEURE

The Company shall not be held liable for any failure, delay, or interruption in the performance of its obligations or in the operation of the Application that results directly or indirectly from circumstances beyond its reasonable control (“Force Majeure Events”).

Such Force Majeure Events include, but are not limited to: natural disasters (earthquakes, floods, fires, storms, or other acts of God); war, hostilities, military actions, civil unrest, or acts of terrorism; pandemics, epidemics, or other public health emergencies; government actions, regulations, sanctions, embargoes, or orders; disruptions or failures of power supply, telecommunications, Internet networks, or third-party infrastructure; hardware or software malfunctions, data center failures, or attacks by hackers, viruses, or other malicious code; labor disputes, strikes, or shortages of labor, materials, or transportation.

During such Force Majeure Events, the Company’s obligations shall be suspended for the duration of the event. The Company shall not be required to compensate Users for any damages, losses, or other consequences resulting from such events.

Users acknowledge and accept that access to the Application may be limited or unavailable during Force Majeure Events and agree that the Company shall not be liable for any resulting inconvenience or loss.

15. DISPUTE RESOLUTION

These Terms are governed and interpreted in accordance with the current legislation of the Republic of Cyprus.

All disputes and differences that may arise in the course of performance of the Terms or in connection therewith shall be resolved through negotiations in good faith. All claims shall be considered by the Company in writing and sent to the Company's email address, namely: hello@i12y.studio, within 30 (thirty) calendar days from the date of sending the letter by the User.

If the Parties fail to settle disputes by negotiations, all disputes, controversy, or claims regarding any issues arising out of or related to these Terms shall be resolved in accordance with the applicable legislation.

You acknowledge that the Company, not Apple, is responsible for addressing any claims by You or any third party relating to the Application or Your possession and/or use of the Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be modified or limited to the minimum extent necessary to make it valid and enforceable while preserving its intent. The remaining provisions shall remain in full force and effect.

The Company’s failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision, and no waiver shall be effective unless made in writing and signed by the Company.

17. ASSIGNMENT

The Company may assign, transfer, or delegate its rights and obligations under these Terms and the Privacy Notice, in whole or in part, to any affiliate, successor, or third party at any time without prior notice or consent.

Users may not assign or transfer any rights or obligations under these Terms without the Company’s prior written consent, and any unauthorized assignment shall be null and void.

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Terms, and that, upon your acceptance of its terms, Apple will have the right to enforce this Terms against you as a third-party beneficiary.

18. WAIVER

No failure or delay by the Company to exercise any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy. Any waiver must be in writing and signed by an authorized representative of the Company.

19. CHANGES TO THE TERMS

The Company reserves the right to amend or update these Terms at any time for any reason by posting a revised version on the Application.

Where an update substantially affects the User’s rights or obligations, the Company will provide prior notice where reasonably practicable and, where possible, at least 15 (fifteen) calendar days in advance. Such notice may be provided, at the Company’s discretion, via an in-app banner or notification in the Application and/or by email to the address associated with the User’s Account (as provided during registration). This prior notice requirement does not apply where changes are necessary to address security risks, prevent fraud or abuse, comply with legal, regulatory, or App Store requirements, or otherwise to protect the Application, the Company, Users, or third parties; in such cases, changes may take effect immediately or on shorter notice.

For non-material changes — such as editorial corrections or clarifications that do not substantially affect the User’s rights or obligations — the Company may update the Terms without prior notice.

Users are encouraged to review the Terms periodically to stay informed of any updates. The current version of the Terms is always available at __.

Continued use of the Application after changes take effect constitutes the User’s acceptance of the updated Terms. If the User disagrees with the revised Terms, they must stop using the Application before the changes take effect.

For avoidance of doubt, discontinuing use of the Application or deleting the Application or an Account does not cancel any subscription purchased through the Apple App Store; subscriptions must be managed through the User’s Apple ID settings.
